GENERAL SALES CONDITIONS

FOR HOLIDAY ACCOMMODATION AND PACKAGES

 (not including professional and private owner adverts)

General:

LOCASUN is a company lead by French law, whose head office is located at 40, rue de la Station, 95130 Franconville, France; and that is registered on the list of Pontoise agencies under the number 488 157 389.

LOCASUN is a travel agency with license number IM095110020 and its financial guarantor is provided by Crédit Agricole.

The use of the websites and the purchase of travel services at a fixed rate or of accommodation offered by LOCASUN assume the client's complete adherence to the present general sales conditions and the acceptance of the specified terms.

The properties offered by LOCASUN are available in a small quantity and are managed in real time. We draw the client's attention to the fact that a property advertised at a certain price may become unavailable if several users connected to the internet at the same time are interested in the same property. The first user to carry out a reservation will have priority. If LOCASUN cannot confirm the reservation due to the property being unavailable, LOCASUN will inform the client by email or letter, and the amount paid by the client to complete the booking will be immediately refunded.

 

1 REGISTRATION, CONCLUSION OF THE CONTRACT AND RATES

 1.1 With LOCASUN

To carry out a reservation of a holiday lasting for 7 days minimum, the client must pay a down payment at more than 35 days before arrival date and must settle the total contract price 35 days, at the latest, before arrival date. For holidays lasting 7 days or less, the total contract price must be paid in order to carry out the reservation. The reservation is confirmed when LOCASUN sends the client a rental contract. The client must sign this rental contract electronically. The total contract price should be settled 35 days, at the latest, before arrival date. In case of a delayed payment, LOCASUN reserves the right to cancel the reservation and retain the down payment.

The selling price includes the rent, booking fee and optional cancellation or multi-risk insurance. The client, having paid the down payment and total contract price, gives his/her assent to occupy the rental premises on the dates and hours fixed in their contract. The key collection can only be carried out once the client has paid the full contract price, along with the payment of any extra services, tourist tax, accommodation facilities and deposit (amount depending on the agency); and once the client’s “Booking Voucher” is also presented on arrival. The term of rent cannot be extended, except on agreement of the agency and on preliminary payment of the rent calculated pro rata temporis.

The rental prices given are indicative and subject to errors or omissions. At reception of the client’s payment, LOCASUN assumes that the client has accepted the terms, conditions, services and prices of the rental holiday. The client cannot claim that they have made a mistake as he/she accepted the conditions of the rental itself, as well as the General Sales Conditions. 

 

1.2 Please note:

Clients reserving a rental with Locasun/160, Locasun/171 or Locasun/271 indicated in the column "Contact" on the advert are under obligation to pay the total contract price to carry out the reservation. 

For legislation reasons, in certain residences or for reasons of comfort or security, LOCASUN reserves the right to ask the dates of birth of the holiday participants.

 

1.3 With LOCASUN Weekend and LOCASUN-VP

To carry out the reservation, the client must do so exclusively online and pay the total contract price immediately only by bank card. The reservation is then confirmed when a “Rental Contract” is sent to the client. The client must sign this “Rental Contract” electronically. Depending on the package, the selling price includes the rent, booking fee, optional cancellation or multi-risk insurance and transport costs.

 

1.4 Payment of extra services and deposit

On arrival at the rental agency or with the owner representing LOCASUN, the client must pay for any extra necessary services (for example rental of bed linen, extra charge for animals...), the tourist tax, utility bills and a deposit that varies between €100 and €4000 depending on the accommodation. 

The means of paying a deposit varies depending on the accommodation but must be paid either by cheque, by providing your bank card details or in cash. The deposit is paid to cover any possible damages to the owner's property and/or the building in general, to cover any thefts (whether this involves breaking and entering) or any losses. If the payment of the deposit appears insufficient, the client commits himself/herself to pay the difference on presentation of the bill for the restoration charges. The rental agency or the owner representing LOCASUN equally reserves the right to deduct the final clean fee from the deposit if the property is not left in a clean state. 

The deposit paid to the rental agency or the owner representing LOCASUN will be returned either at the end of the lease or by post in a minimum of thirty days, after possible deduction of the value of the damaged or missing objects, the cost of restoring the accommodation and the bank charges for a payment by bank transfer or in foreign currency. The difference will be repaid within 3 months or less after the deposit is cashed.  

 

2 CONDITIONS OF PAYMENT

LOCASUN accepts the following for payments by bank card: Visa, MasterCard and Carte Bleue (French banks only).

The client guarantees that he/she is fully authorised to use the bank card used to pay for the rental and that this card contains sufficient funds to cover all costs resulting from the use of LOCASUN’s services.


Regarding a reservation made on the site
www.locasun.co.uk less than 35 days before arrival, the client has the possibility to pay online by bank card first and then send a cheque (French banks only) or French cheques vacances up until the 15th day before arrival. The client's bank card will then be credited with the amount given by the cheque or cheques vacances.

The client can track his/her reservation process at any time by accessing the "my account" area. He/she will then have access to all the necessary information concerning his/her rental reservation.

 

 

3 CONDITIONS OF ACCESS TO THE LOCASUN-VP OFFERS

3.1 Recommendation

To become a member of LOCASUN-VP, you must register yourself. It is not obligatory to recommend somebody or to be recommended by somebody in order to validate your subscription.

There is no limit to the number of people that can be recommended. However, the mass recommendation to people outside the field of close friends and family, through a website, blog, discussion forum, adverts on the internet or even by using the brand names of website partners or by reproducing a part of the website's catalogue, is strictly forbidden. If a member does not respect these conditions, LOCASUN will take the necessary measures to stop this unconventional recommendation process.

By recommending several close friends or family members, the LOCASUN member receives a €15 discount on each of their first bookings and is automatically informed of this by email. On the payment of each booking, the discounts, which are cumulative, will be automatically deducted from the total contract price. The discounts are valid for one year on the website and they can be consulted by going into “my account”.

 

3.2 Regarding LOCASUN and LOCASUN Weekend members

LOCASUN and LOCASUN Weekend members can access the LOCASUN-VP offers without being recommended by anybody. An invitation is sent out to each member to become a member of LOCASUN-VP.

 

 

4 LOCASUN-VP

4.1 Price

The website www.locasun-vp.fr has offers which offer discounts ranging from -30% to -70%. Next to the sale price is the standard price that is normally charged by the property owners at the time of sale. This price can vary depending on the time of year and LOCASUN promises to display the lowest standard price. The agency confirms that the standard prices are valid. 

 

4.2 Offer duration

The sales offers displayed on LOCASUN-VP, and maintained under the present General Sales Conditions, should be valid whilst they remain online up until all availabilities are gone, and can change in real time. The photos that appear in the description are simply a representation of the property and are not contractual.

 

4.3 Length of the holiday

  The length of your holiday includes:

- The arrival date at the rental from the time of departure from the airport
- The date of the return journey at the time of arrival at the airport

The prices are calculated according to the number of overnight stays, and not the number of full days. 

The first and the last day are generally dedicated to travel. If it occurs that, due to the schedules imposed by airline companies that the first and/or last day are shortened by a late arrival or early departure, no refund will be given. The same applies if the duration of the stay is lengthened. No compensation can be granted for returning a day later than that stipulated in the contract. It is wise to consider this eventuality and therefore to make the necessary arrangements for your personal or professional affairs.

 

5 TRANSPORT

On the LOCASUN-VP website, certain offers include accommodation and flights. With these offers, special rates are proposed according to the conditions and the availability of flights at the time of reservation and according to the economic conditions prevailing on this date: price of fuel, expenses…

The times, route and type of plane are consistently communicated to the client subject to alteration at the last minute. Any unlikely or ‘force majeure’ event having an impact on the volume of traffic or on punctuality will not involve the responsibility of LOCASUN. If, due to the transport schedule, the first and last days of the client’s holiday are shortened, no refund will be given.

 

6 ADVERT COMPLIANCE

6.1 Accommodation photographs

The rentals are furnished for the use of tourist holidays. The photographs published on the LOCASUN websites or sent by email give a representation of the rentals but are not contractual. The rental chosen may not correspond exactly to the pictures.

 

6.2 Accommodation descriptions

The above (6.1) also applies for the descriptions of the rentals (size, layout, type of sleeping arrangements…) which are composed by type of accommodation. This implies that for two rentals of the same type, there may be some slight differences. In the descriptions, LOCASUN guarantees the maximum number of people that each type of rental can sleep but it cannot guarantee the type of bedding that will provided (number of double beds, single beds, canapé beds, bunk beds…). In the descriptions, the maximum number of beds is specified for each type of rental. The utilisation of the rental at full capacity may imply a reduced comfort.

 

6.3 Optional and obligatory services

 

The prices of optional and obligatory services (for example final cleaning; rental of sheets, towels, cots, air conditioning, television, internet connection; parking; swimming pool; deposit; tourist tax; charges; animals…) are given as indicative prices only. These prices are decided by the owner and are to be paid at the agency or with the owner representing LOCASUN. LOCASUN is not responsible for any modifications in these prices over time. Similarly, if a satellite television is indicated in the description, this does not necessarily mean that all the French channels can be received.

 

6.4 Compliance according to the season

In low season, there may not be as many services offered. The swimming pools and restaurants may be open with limited choice and hours, and in bad weather conditions, cleaning, maintenance, lack of clients or for any other reason outside of the agency's control, it is possible that these services cannot be offered. The swimming pools are open according to the season, therefore the client is responsible for finding out these opening and closing dates from LOCASUN before a booking is made. Important: foreign regulations do not impose swimming pool security.

 

6.5 Tourist information 

Information regarding the resort’s sports and leisure activities is provided by the Tourist Offices. It does not engage the responsibility of LOCASUN.

 

7 OCCUPATION OF THE PREMISES

The rental premises are only to be used as a holiday rental. The client only has the right to enjoy the use of the premises sensibly and is not permitted to sublet or transfer his/her rights without the formal consent of the agency. Any professional activity is forbidden in the rented accommodation.

The client must conform to the internal regulations of the building, particularly regarding noise, washing lines, cleanliness and the refuse disposal... If these regulations are not respected, the agency, residence or hotel, reserve the right to make the client leave the premises without a refund for the unoccupied days. The premises are rented according to the dates and hours fixed in the contract. In case of arrival outside of office hours, the client must warn the agency in advance to ensure their arrival is arranged in the best possible way. An arrival outside of office hours may incur an extra charge.

On the day of departure, the premises must be promptly vacated and restored to a perfect state of cleanliness and keys must be handed back to the agency or owner representing LOCASUN. If the premises are not left in a clean state, the fees for the final clean and for the restoration of the property will be charged. For every hour that the client is delayed for the delivery of keys, he/she will be charged €30.

If the number of occupants is superior to that stipulated in the contract, the agency can refuse entry to the rented property or claim extra rent fixed as follows:

> €60 per person for a studio (1 room rental).

> €90 per person for a 2 room rental.

> €120 per person for a 3 room rental.

> €150 per person for a rental with 4 rooms or more. 

The client cannot introduce pets into the rented property without first warning LOCASUN and if "Pets allowed with prior authorisation" is indicated on the advert or the contract. LOCASUN will reconfirm its agreement and will inform the client of the extra charge to pay on arrival. Animals noted under the 1st or 2nd category of the n°99-5 law of 6th January 1999 will not be accepted in any case. In certain accommodations, an anti-rabies certificate may be required. If these conditions are not adhered to, access to the holiday rental can be forbidden, however the client’s holiday rental and billing will remain the same. Animals should not be detrimental to the peace and security of other residents and they must respect the basic hygiene regulations. It is also demanded that the animal is kept on a lead in the buildings surroundings. Animals are however forbidden in certain communal building areas (restaurants, swimming pool…).

All ads with the reference Locasun/124 are exclusively for families (parents+ children). In case of no respect of this clause, you take the risk of being refused access to the rental without refund.

 

8 INVENTORY, STATE OF REPAIR AND OBLIGATIONS OF THE CLIENT

 

On arrival, the client is required to check the inventory and state of repair. It is obligatory that any client claim must be immediately reported to the agency or the owner representing LOCASUN. The client has 24 hours to inform the agency or the owner representing LOCASUN of the faults noticed. After this time, the rented property will be regarded as free from damage on the client's entry to the premises and no complaints of faults noticed will be further accepted. Any complaint made must also be made to LOCASUN in the 14 days following the end of the stay. After this period, LOCASUN will not consider any complaints received. Complaints will be dealt with in a minimum of 30 working days.

Before initiating any legal proceedings (submissive claims might be rejected by justice), the co-contracting parties will try to come to an amicable agreement. The client must authorise any urgent or necessary works or repairs to be done to the property during the period of occupation. No compensation will be granted if it is urgent or necessary to enter the property during the period of occupation.

 

Before departure, the client must put the furniture and any other furniture objects back to their original place. The client agrees to return the property as well as the furniture to a perfect state of order and cleanliness, namely the washing of floors, windows, mirrors, sinks, toilets, dishes, pans, refrigerator (to be defrosted and left open), vacuum cleaner (to change the bag if necessary), riddance of food, sponges...

 

Similarly, the client must refrain from placing any items in the toilets/bath that are likely to block the pipes, otherwise, he/she will be held financially responsible for the charges brought about by the reparation of damaged equipment.

 

Garden furniture must be put away during excursions or on departure in order to avoid theft otherwise the client will be help responsible for negligence by LOCASUN.

 

On departure, the client will have to securely shut the premises and return the keys to the agency or the owner representing LOCASUN. If the keys are not returned, the cost of replacing the locks will be deducted from the deposit and, if necessary, an extra charge can be demanded immediately on the premises or at the agency. 

  

9     CONDITIONS IN CASE OF CANCELLATION OR MODIFICATION

9.1 Cancellation or modification of the contract by the client

9.1.1 On LOCASUN.co.uk

The cancellation or modification fees will be retained according to the fees listed below:

> More than 60 days before arrival: 30% of the total contract price with a minimum of €40 supplement to pay.

> Between 59 and 35 days before arrival: 50% of the total contract price.

> Between 34 and 15 days before arrival: 75% of the total contract price.

> Less than 15 days before arrival: 100% of the total contract price.

In all cases, the booking fee and the insurance, if applicable, will be lost.

Any cancellation or modification must be reported to LOCASUN in written form within 3 days of the event causing demand for cancellation or modification and will only be taken into account on receiving the client's letter.

If the client occupies the property after the arrival date in the contract or leaves the property before the departure date, he/she will not be able to claim a refund for the period the property was not occupied.

If the client does not arrive within 48 hours of the date the rental period begins, and with absence of additional information, the contract will be automatically cancelled with the total contract price of the rent still being required.  

LOCASUN contract cancellation: if any unforeseeable circumstances occur or if a ‘force majeure’ event prevents the client from occupying the property, LOCASUN can cancel the contract before the rental period begins and suggest alternative accommodation of similar value. A new contract is then established in writing. If no alternative is found, you will immediately get a full refund without any fines on the amount of money that has already been paid.

 

9.1.2 On LOCASUN-VP

The cancellation or modification fees vary depending on the service providers that contribute to carrying out your holiday. Subject to particular details in the description of your chosen trip the fees listed below will apply. The airport taxes are always reimbursed whatever the reason for cancellation.

Applicable to all holidays:


> More than 60 days before arrival: 30% of the total contract price with a minimum of €40 supplement to pay. 

> Between 59 and 35 days before arrival: 50% of the total contract price. 

> Between 34 and 15 days before arrival: 75% of the total contract price. 

> Less than 15 days before arrival: 100% of the total contract price.

For coastal cruises: the fees list for cancellation fees is always displayed in the description of the offer.  Only the cancellation fees of our service providers are applicable. 

For "sports events" products, the current cancellation or modification conditions are those used by our partners. They appear, for each offer of this type, in the section "To note" of the description. 

For all packages:
- Booking fee and insurance: 100% of the total service price for a complete cancellation.
- In case of absence or of an arrival at the incorrect time: 100% of the total service price.

 

9.2 Please note:

In case of cancellation of a reservation with the reference Locasun/160, Locasun/171 or Locasun/271 in the "Contact" section, the cancellation fees increase to 100% of the balance total on the day of reservation. It is to be noted that in all cases, the booking fee and the optional insurance will be lost.

In case of cancellation of a reservation with the reference Locasun/217 or Locasun/364 in the “Contact” section, the cancellation fees increase to 100% of the balance total at less than 35 days before arrival date at the rental.

 

 

9.3 Cancellation of the contract by LOCASUN

If unforeseeable circumstances require, or if a ‘force majeure’ event makes it impossible to occupy the property, LOCASUN reserves the right to cancel the contract before the rental period begins and suggest an alternative rental of similar value. A new contract is then established in writing. In the case where no alternative is found, LOCASUN will immediately refund the amount in full that has already been paid by the client.

The prices of holiday rentals published on www.locasun.co.uk are indicative and subject to error or omissions. In the case of error concerning the price of the rental, LOCASUN reserves the right to cancel the reservation up to 3 French working days after it has been made, with no compensation granted to the client.

In the case where rental stock is updated on LOCASUN’s websites, given any technical or technological problems, LOCASUN reserves the right to cancel a reservation up to 3 French working days after it was made with no compensation granted to the client.

 

10  CLIENTS’ RESPONSIBILITY

The owner and the agency representing LOCASUN accept no liability concerning the rental risks accrued by the clients’ furniture or personal property, particularly in case of climatic disasters, fire or theft. All client's items or personal belongings are his/her own responsibility. These possessions are not covered by a specific insurance policy issuing from the property, the owner or the agency representing LOCASUN. The client must take out his/her own insurance policy to cover his/her belongings, particularly against theft. Furthermore, the client is required to take out an insurance policy to cover renting risks and the rented goods, as well as against a third party claim. The client will have to provide documentary evidence on request to the owner or the agency. The owner and the agency representing LOCASUN accept no liability for an appeal which their insurance company could exercise against the client in the event of an accident or disaster.

 

11 MICELLANEOUS

11.1 Building works

It may occur that unexpected building works are undertaken near the client's accommodation. LOCASUN accepts no responsibility regarding disruptions that result and exercises no influence over the continuation of the works. The client cannot demand any compensation for such a situation.

 

11.2 Electricity and water

It is possible that the client may encounter a discontinuation in the water and electricity supply during his/her stay. The local government or regional authorities can decide to put into place a temporary cut in the supply or reduce its distribution for a variety of different reasons. In no way are LOCASUN or the owner or agency representing LOCASUN to be held responsible for these inconveniences. 

 

11.3 Energy consumption

Depending on the season, a considerable amount of heating or air conditioning may be consumed. As a result, it is possible that an extra charge may be requested per week.

 

11.4         Reminders

 

According the act n°95 949 from 25/08/1995, bunk beds are not suitable for children less than 6 years old.

Bulldogs, other guard or defense dogs, and dogs of an aggressive nature are forbidden to enter any accommodation published on LOCASUN’s websites.

 

11.5 LOCASUN offers

Locasun offers rentals where the services provided are not necessarily included in the package price. As a result, no complaints on this subject are taken into consideration by LOCASUN.

 

12 SKI PACKAGES: SKI-PASS

12.1 Ski-pass: definition and use

The ski-pass gives access (without priority of any nature and only during the specified duration of the ski-pass) to the ski lifts which are specified on the ski-pass and that are in working order.

Your ski-pass is valid in the areas that are defined on the ski slopes map for the winter season concerned and during the time the ski lifts are open. These times are displayed at the main desks and they are subject to weather, snow or economic conditions.

The user must carry the ski-pass during the whole ride on each ski lift, from the departure station to the arrival station, so that it can be presented to an official agent who has the right to check the pass at any moment.

The prices are in € (Euros) with all taxes included but without insurance. LOCASUN reserves the right to modify the prices at any moment, with any advance warning.

The opening and closing dates of the ski lifts indicated on LOCASUN’s websites are given as a rough guide and are susceptible to change according to snow conditions.

 

12.2 Photographic identity and proof of identity

Certain ski-passes must carry a recent photograph of the holder, which must be face-on, without sunglasses or headwear.

The possibility of benefiting from a price discount or free pass for certain age groups is subject to the compulsory presentation of an original piece of identity or that of a relation when collecting the ski-passes at the ski lifts desk. No photocopied proof of identity will be accepted.

The client's age will be taken into account from the first day included in the duration of the ski-pass.

No price discount will be granted after the ski-pass has been purchased.

 

12.3 Violation of the terms of transport

Any person using a ski lift that gives access to the ski area, without a ski-pass or carrying the wrong pass will be liable to prosecution and a fine as indicated here below. The same applies if there is a lack of respect on the part of the pass holder in following police regulations displayed at the ski lifts departure station.

The ski-pass must be presented at each control check carried out by the official agents of the ski lifts company. The absence of a ski-pass or the use of a wrong or stolen ski-pass (for example: the use of a child's ski-pass by an adult) is liable to the payment of a fine equal to five times the value of the daily pass and if required, of the amount owed to the type of lift (Article L342-15, R342-19, R342-20 of the Tourism Code) plus the booking fee which is fixed today at €38.

The falsification of a ski-pass and/or the use of a falsified pass are liable to criminal prosecution as well as to the payment of damages and interest. 

In all of the aforementioned cases, the ski lifts company can proceed to the deactivation of the ski-pass.

 

12.4 Passing on and resale of ski-passes forbidden

The ski-pass is strictly individual and non-transferable for the total length of its validity.

In accordance with the clauses of article L121-20-4 of the Consumption Code, the right to cancel the pass, foreseen in articles L121-20 and onwards in the Consumption Code, is not applicable in terms of distance selling. 

Therefore, for any order made with LOCASUN, you will not benefit from any right to cancel the ski-pass. 

 

12.5 Refund of the ski-passes

Any ski-pass reserved or paid for that has not been used or only partially used will be neither refunded nor exchanged, whatever the cause; illness, accident or any other personal reason, and however long the pass is valid for. The client is advised to take out an insurance policy to cover this risk.

Stolen or missing ski-passes will not be replaced.

 

12.6 Interruption in the operation of the ski lifts

In the event of the partial or complete closure of the ski lifts for more than a day, caused by a lack of snow, weather conditions or an electricity cut; the ski company will bear the cost of the ski-pass but however has freedom in fixing these terms. In any case, it is required that the client shows an original piece of identity.

 

12.7 Respecting the safety regulations

The ski-pass holder is obliged to respect the safety regulations regarding ski lift transport, notably the police regulations displayed at the ski lifts’ departure station and guidelines for individual behaviour subject to the imposition of penalties.

The ski-pass holder must respect the bylaw relating to safety on the ski slopes. The client is also recommended to take into consideration the "10 codes of conduct for slope users" released by the International Ski Federation (ISF). 

 

 

13 PRIVACY   

Any personal information provided by the client on LOCASUN’s websites is strictly confidential. In accordance with the law in force, your information will be in no way transferred to a third party. LOCASUN ensures that this information will only be used by its internal services to process a client's reservation, to confirm and personalise the communication of information by letter or email, and to personalise the client’s use of the website according to their preference. The client has the right to change or delete his/her personal information by sending an email request on the LOCASUN website.

 The customer has the right to change, delete his data or unsubscribe by sending an email request to reservation@locasun.com on Locasun website, or by phone at 0033 1 34 44 07 30, or by mail to Locasun : 40 rue de la station - - 95130 Franconville FRANCE . To unsubscribe from an email sent by Locasun website, the customer will be offered automatically at the bottom of each e-mail a link to unsubscribe and stop the sending of future newsletters.

 14 INFORMATION DATA-PROCESSING

LOCASUN is expressly authorised to hold the information included in the “Rental Contract” on computer file. In accordance with the law of 6th January 1978, the client has the right to express his/her demands of access and rectification with LOCASUN. The terms of application will be fixed by mutual agreement.

 

 15 DECREES AND LAWS ON ONLINE BUSINESS AND TOURISM

15.1 Online business

15.1.1 Laws on the right to cancellation

According to article L121-20 (find out more about this article here),  the client has a period of seven full French days to exercise his/her right to cancellation without having to justify the reasons or to pay any fines, with the exception, if the case arises, of administrative refund fees. The client can depart from this period where he/she needs to have immediate treatment, necessary to continue living. In this case, the client will continue to benefit from the right to cancellation without having to justify the reasons or to pay any fines.

The period referred to in the previous paragraph begins on rental confirmation for a property rented by LOCASUN or on the acceptance of an offer regarding service providers. 

According to the article L121-20-1 (find out more about this article here), when the right to cancellation is exercised, the professional owner is obliged to refund the total amount paid by the customer, as soon as possible, and at the latest in the thirty days following the date that this right was exercised. Beyond this, by rights, the amount benefits from the legal rate of interest in force. This refund can be made in any form of payment. On the professional owner's suggestion, the customer having exercised his right to cancellation can however choose another method of repayment.  

 

15.1.2 Exceptions

According to the article L121-20-4 (find out more about this article here),  the terms of the articles L. 121-18, L. 121-19, L. 121-20 and L. 121-20-1 are not applicable to contracts which have the subject of:

The everyday supply of consumer goods at the consumer’s home or place of work by suppliers making frequent and regular rounds;

The provision of accommodation, transport, catering, leisure services that should be supplied on a certain date or according to a determined schedule.

The terms of the articles L. 121-18 and L. 121-19 are however applicable to the contracts completed online when they have as a purpose the provision of the services named in 2°.

 

15.2 Tourist services

The present General Sales Conditions have been fixed according to decree n°94-490 of 15 June 1994 (find out more about this decree here) applied from article 31 of law n°92-645 of 13th July 1992 (find out more about this law here).

LOCASUN, a Polyweb trademark, is an internet website that promotes and advertises holiday rentals. For adverts published by private owners or private agencies, LOCASUN has no other intermediary obligations and does not guarantee the completion or the positive result of a transaction of any kind. In no way is LOCASUN responsible for errors, omissions or fraud resulting from the negative use or reproduction of adverts that are published on it. LOCASUN agrees to publish adverts on the internet that are created via the online registration form for the duration of the period paid for by the advertiser. This period begins on the first day of publication. LOCASUN reserves the right to refuse the publication of all or part of an advert, at any time, without notice and for any reason. The advertiser guarantees that the information provided to LOCASUN is correct and up-to-date. He/she confirms that they are the copyright holder of any material passed on and authorises LOCASUN to publish this information. This material will not be returned. The ads not available in the tab "Prices & availabilities" will not appear in the results of LOCASUN research. LOCASUN requires a ten-day period to verify the creation and modification of all advertisements either by post or electronically. In order to cancel an advert, LOCASUN must be notified in writing and no refund will be given following this. Any technical interruptions to the internet network do not give any right to compensation. The tariffs and sale conditions can be modified at any time and without notice.
